Terms of Service
1. General
Q-Control is a website owned by Hewall Safety Sweden AB ("Hewall Safety"). Through Q-Control, Hewall Safety offer their business customers ("Customer") access to information and services. Through the agreement that the Customer have enter into with Hewall Safety about electronic communication services ("Agreement") the Customer are given access to Q-Control.
Through Q-Control the Customer may use inspection functions which the Customer have ordered from Hewall Safety.
Hewall Safety reserve the right to make changes to Q-Control and the functions, services, traits and properties of which Q-Control supports, including usernames and passwords, without informing the Customer in advance.
2. Administrators and Users
The Customer must assign at least one (1) administrator with the rights to represent the Customer in Q-Control.
The Customer must always have atleast one (1) administrator selected in Q-Control.
Employees, consultants and other users at the Customer ("Users") has some permissions to Q-Control. The Customer is responsible to make sure that all of their Users are using Q-Control in accordance with the Agreement and these Terms of Service and where applicable, as defined for the Customer. Users with access to use Q-Control as stated above are considered to have full rights to make purchases on behalf of the Customer and otherwise use Q-Control as defined in the Agreement. The Customer may give and revoke permissions in Q-Control for their Users as they see fit.
The Customer is responsible to make sure all of their Administrators and Users have personally agreed to let Hewall Safety store and process any personal data in use of Q-Control.
The Customer or Users may choose their own username and password. Hewall Safety may change your username and/or password for technical reasons or other reasons based on a governments decision.
3. Customers liabilities and responsibilities using Q-Control
The Customer shall carefully protect their usernames and passwords including other data which may be used to gain access to Q-Control and keep such information confidential to keep Q-Control from unauthorized usage.
The Customer is responsible for keeping login credentials secured and only available to those who have the rights to use them as representatives of the Customer. It is the Customers responsibility to make sure outsiders does not get hold of their usernames and/or passwords.
If usernames and passwords are leaked, suspected of being leaked or otherwise have gotten lost, the Customer must immediately inform Hewall Safety about it. Hewall Safety has the right; but is not obligated; to prevent the Customer to use Q-Control and disable the Customers account without notice if Hewall Safety have reasons to believe that a Customers account are being used unauthorized.
If a person with a username for Q-Control have been employed at the Customer or otherwise used Q-Control on behalf of the Customer, but no longer work for the Customer or are otherwise no longer authorized to represent the Customer, the Customer must immediately revoke the access to Q-Control for that person.
The Customer are solely responsible for all usage within Q-Control and all actions taken through the Customers account. The Customer is also responsible for all services and functions that are being used through Q-Control and for all agreements made through Q-Control, even if the Customers account have been used unauthorized.
4. Especially about customer details
If Customer Data for which the Customer is to be regarded as the person responsible for according to the General Data Protection Regulation is processed within the framework of Q-Control, Hewall Safety is acting as assistant regarding such data. The Customer is responsible for the processing of Personal Data in accordance with applicable legislation. Hewall Safety undertakes to process Personal Data only in accordance with the Agreement.
Hewall Safety shall by technical means protect the Personal Data. Hewall Safety shall be prepared to comply with authority on decisions and measures to comply with the law's security requirements for the Customer's Personal Data. Hewall Safety shall immediately notify the Customer upon detection of completed cases or attempts to gain unauthorized access, destruction or alteration of the Customer's Personal Information.
Hewall Safety shall allow the inspections that the authority may require by law for the processing of Personal Data.
5. Fees and payment
Upon registration, a 30 day trial period begins. After the test period, the Customer may choose to purchase access to Q-Control and a license fee will be paid annually. However, in order to give more Users access to certain fee-based functions or sub-services within Q-Control, the Customer must sign separate agreements.
Payment of ordered licenses through Q-Control takes place in the same way as the Customer has approved in connection with its purchase of access to Q-Control. Hewall Safety's standard prices shall apply unless otherwise explicitly agreed upon in writing.
6. Immaterial rights
The content and appearance of Q-Control are protected by copyright. The ownership and intellectual property rights of Q-Control and the services and functions used through it belong to Hewall Safety or a third party. This also applies to the information contained in Q-Control, the services and the functions. The Customer does not receive any rights to Q-Control or the services and functions used through it, nor to the information it contains, except the right to use Q-Control as stated in these Terms of Service, the service descriptions and any special terms.
Any use of Q-Control and its parts other than the use, copying, translation, modification and storage in accordance with these Terms of Use, regardless of the manner, is prohibited without Hewall Safetys's prior written consent.
7. Right to change the terms of use
Hewall Safety is entitled to change the terms of use for Q-Control. Hewall Safety also has the right to change the contract terms and service descriptions applied to Q-Control and the services and functions used through it.
8. Operation
Q-Control is normally in operation 24 hours a day, seven days a week. However, the operation is unsupervised during certain times and operational interruptions during these times may occur. Furthermore, Hewall Safety has the right to restrict the operation of Q-Control, for example, to carry out upgrades.
9. Responsibility for content
Hewall Safety is constantly working on updating the details on www.hewallsafety.se and www.q-control.se. However, Hewall Safety cannot guarantee that all information presented is accurate and up to date and liability towards Hewall Safety cannot be claimed on the basis that incorrect information is presented, nor for any other loss or damage that use of Q-Control may cause the Customer.
10. Length of agreement
The agreement on Q-Control is valid until the end of the year and is renewed annually if the Customer does not terminate the Agreement in writing no later than last November. When the Agreement has expired, Hewall Safety has the right to delete all information and materials stored regarding the Customer. The customer is responsible for securing access to and storing the material from Q-Control that the customer wishes to keep.
